PERSONAL INJURY
Personal Injury is an injury to either the body, emotions or mind. This term is generally used when the injury to a person has been caused due to the negligence of the other. The most common personal injury claims include accidents at work, road traffic accidents, assault claims, tripping accidents, accidents on holiday and accidents as a result of the use of a defective product. Many medical accidents are also included in the personal injury and it leads to several medical negligence claims every year. Some conditions often classified as such medical claims include industrial disease such as chronic bronchitis, silicosis, chest diseases, asthma, occupational deafness etc.
In England, the law in this area operates by, provided the party has been found guilty of negligence, providing the injured party with monetary compensation. In some countries the system is very controversial and complex in comparison with our own. In some eastern countries, the victim has to submit the case in the court within three days of the accident, otherwise, he/she will lose the right to get the claim. However if the injured party is below the age 18 at the time of accident he/she may postpone the case in court until they are 21 year of age.
A Conditional Fee Agreement (CFA) is used in some countries, where the term No Win, No Fee is used. This agreement is between the client and the lawyer handling the case. If the lawyer loses the case, the client does not have to pay costs.
